Jim Bivins

As a life-long resident of Moultrie, I came home 41 years ago and began practicing law after graduating from the University of Georgia School of Law. My family background includes lawyers and realtors. Initially practicing with a local law firm, Short & Fowler, I went into solo practice in 1993. Since that time, it has been my honor and privilege to represent thousands of clients in handling their legal matters. My practice has been diversified, but in the past twenty or so years, I have concentrated in the fields of real estate law (closings and litigation) and probate. I am currently serving as the county administrator for Colquitt County appointed by our Probate Court to represent unrepresented estates and individuals on a regular basis. I have also served as court appointed conservator on numerous occasions.

In the past forty years, I have drafted hundreds of wills, powers of attorney and closed several thousand real estate transactions. In 2007, my father was diagnosed with a rare disease and had to go into the nursing home. In the process, I helped my mother in getting him into a nursing home and applying for Medicaid to help with the nursing home cost(s). I also helped my mother to preserve her assets and her ability to live in her home and not to lose her home when my father passed in 2019. I became very familiar with the Medicaid application process and the ins and outs of preserving assets while still qualifying a loved one for Medicaid to reimburse nursing home costs. In the years since, I have helped several families qualify their loved ones for Medicaid. Having gone through the process with my own family, I understand the emotions and heartache involved in the process and enjoy helping other families minimize the financial burden(s) of placing a loved one in the nursing home. Conversely, I have also seen clients lose their estates and family properties to Estate Recovery by the state of Georgia.

We also offer a full range of legal services including estate planning, drafting wills and trusts (both revocable and irrevocable). Client’s wife was being admitted to a nursing home in a specialized unit costing nearly $15,000 a month. The client had $450,000 in liquid assets and $150,000 in land and $3,500 a month income. Our team put a plan together to save their assets. With our plan, the clients qualified for Medicaid and saved 100% of their assets.

Granddaughter who was the agent for her Grandmother under a power of attorney came to see our team. The Grandmother had $250,000 in liquid assets with an income of $1,500 a month.
